Introduction

This policy (the "Privacy Policy") explains how we collect and use your personal information that we or our service providers collect about you when using the Interface (as defined in our Terms). This Privacy Policy is a part of the Terms, and should be read in conjunction with them.

All capitalized terms not defined in this Privacy Policy will have the same definitions and meanings as defined by the Terms.

Please review the Privacy Policy periodically as we may revise it from time to time. If you use the Interface following a change to this Privacy Policy you agree to accept the revised policies. If you do not agree with or accept our Privacy Policy in its entirety, you must not access or use the Interface.

YOU ACKNOWLEDGE THAT WE USE SERVICE PROVIDERS TO MAKE THE INTERFACE AVAILABLE TO YOU, AND THAT THESE SERVICE PROVIDERS MAY INTERCEPT YOUR COMMUNICATIONS, COLLECT PERSONAL INFORMATION ABOUT YOU AS YOU NAVIGATE OR USE THE INTERFACE, AND TRACK YOUR ACTIVITIES. BY USING THE INTERFACE, YOU SPECIFICALLY CONSENT TO THIS INTERCEPTION, TRACKING AND DATA COLLECTION BY OUR THIRD-PARTY SERVICE PROVIDERS.

This Privacy Policy applies to information we may collect:

  • On the Interface;
  • In email, text, and other electronic messages between you and the Interface;
  • When you interact with our advertising and applications on third-party websites and services, if such advertising or applications include links to this policy; and
  • Through any other means associated with or relating to the Interface.

This policy does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by us or any third party (including our affiliates and subsidiaries); or
  • Any third party outside the Interface, including through any application or content (including advertising) that may link to or be accessible from or on the Interface.

Information Collected and How We Collect It

We may collect the following information from or about you as you use the Interface:

  • Digital wallet address, transaction history, completed transaction hashes, digital assets names, symbols, or other blockchain identifiers of the digital assets that you transact through the Interface, and other associated information.
  • Interactions with the Interface including but not limited to usage data and preferences.
  • Information about the device you use to access the Interface, including about your computer and browser, operating system, data usage, data transferred, geo location, and IP address.
  • Information provided by third parties or publicly accessible databases which we may combine with other information collected about you.
  • Your browsing history, including the areas within our Interface that you visit and your activities there, including remembering you and your preferences.
  • Information about your internet connection and internet provider.

We collect this information:

  • Directly from you when you provide it to us, such as when filling out forms on the Interface (including when you register for an account, subscribe to a service, or request something from us, or when you fill out surveys, if any such features are available to you).
  • Automatically as you navigate and use the Interface, including through the use of cookies, web beacons, and other tracking technologies and analytics services;
  • From third parties, for example, our business partners and service providers;
  • Records and copies of your correspondence (including email addresses), if you contact us through the Interface;
  • When you engage in transactions on the Interface;
  • When you run searches on the Interface; and
  • When you contact our customer service agents, if available.

Use and Disclosure of Your Information

Where applicable, we will use or disclose any information collected as directed by you and in accordance with the Terms. Further, we may use or disclose your information in the following ways:

  • To provide our services and make the Interface available, continue to develop it and maintain it;
  • To enforce the Privacy Policy or Terms;
  • To comply with Applicable Laws which may require us to, upon request by government agencies, take certain actions or provide certain information;
  • To respond to third party, legal, and governmental inquiries; and to investigate any illegal or fraudulent activity;
  • To enhance or improve our users' experiences;
  • To send and receive information to you via selected communication methods as set forth within the Terms or when requested by you;
  • To notify you of additional services and updates that we provide;
  • To assist in maintaining the functionality, safety, and security of the Interface;
  • To share your information with third party contractors and service providers hired by us to perform functions and provide services to us such as infrastructure providers, Blockchain Technology providers, marketing providers, and other vendors we use to make available the Interface;
  • To release to governmental entities, authorities, or legal claimants as needed;
  • To detect, prevent, and mitigate financial crime and other illicit or harmful activities on the Interface;
  • For any other purpose as needed for our business;
  • In any other way we may describe when you provide the information;
  • In the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets or equity, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding;
  • With our affiliates; and
  • For any other purpose with your consent.

Automated Data Collection Technologies

Third party tools collect information about you as you use the Interface. You acknowledge and understand that these third parties will collect information about you and your actions as you browse and use the Interface, and may monitor and intercept your communications. These service providers may use the information they collect for their own benefit, without any restriction. You specifically agree to this arrangement, and consent to your communications and information being intercepted and collected by these third parties.

The information we collect automatically may be statistical data and may also include personal information, or we may maintain it or associate it with personal information we collect in other ways or receive from third parties. This information enables us to:

  • Allow you to use and access the Interface;
  • Prevent fraudulent activity and improve security functionality;
  • Assess the performance of the Interface, including as part of our analytic practices, or otherwise to improve the content, products or services offered through the Interface;
  • Offer you enhanced functionality when accessing the Interface, including identifying you when you connect your digital wallet, and keeping track of your specified preferences;
  • Estimate our audience size and usage patterns;
  • Speed up your searches; and
  • Analyze our services and products and perform market research.

When you visit or leave our Interface by clicking a hyperlink or when you view a third-party site that includes our plugins or cookies (or similar technology), we may automatically receive the URL of the site from which you came or the one to which you are directed.

We may also receive location data passed to us from third-party services or GPS-enabled devices that you have set up, which we may use for fraud prevention and security purposes. If you no longer wish for us, our affiliates, or our service providers to collect and use location information, you may disable the location features on your device. Consult your device manufacturer settings for instructions on how to do this. Please note that if you disable such features, your ability to access certain features, services, content, or products may be limited or disabled.

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. Note that while you can set your browser to not allow cookies, we may not be able to honor that request, and may track your activity and collect information about you and your online activities even when the browser is set to "do not track";
  • Flash Cookies. Certain features of the Interface may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Interface. Flash cookies are not managed by the same browser settings as are used for browser cookies and you may not be able to shut down our collection of and use of information through this technology;
  • Web Beacons, Pixels and Tags. Pages of the Interface and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity);
  • Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Interface, such as information about the links you click on;
  • ETag, or entity tag. An ETag, or entity tag, is a feature of the cache in browsers. It is an opaque identifier assigned by a web server to a specific version of a resource found at a URL. It is one of several mechanisms that HTTP provides for web cache validation. These allow websites to be more efficient and not serve content again, when data is already cached and ready to view;
  • Fingerprinting. Fingerprinting refers to the collection and analysis of information from your device, such as your operating system, plug-ins, system fonts and other data, for purposes of identification;
  • Recognition Technologies. Recognition technologies refers to various technology features used by websites, including application of statistical probability to data sets, which attempt to recognize or make assumptions about users and devices (e.g., that a user of multiple devices is the same user); and
  • Log Files. These track actions occurring on our Interface, and which help us collect your IP address, browser type, Internet service provider, the webpages from which you came or to which you go before and after visiting our Interface, and the date and time of your visits.

Third-Party Use Tracking Technologies

Some content or applications on the Interface may be served by third-parties, including advertisers, ad networks and servers, content providers, and application providers (e.g., Chainalysis, Alchemy, Datadog, and Mixpanel). These third parties may use blockchain analytics technologies and other tracking technologies such as cookies, web beacons, or other technologies, to collect information about you when you use the Interface. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different blockchains, websites, and other online services. They may use this information to conduct investigations or to provide you with interest-based (behavioral) advertising or other targeted content. We do not control how these third parties handle your data and you should review their privacy policies to understand how they collect, use, and share your personal information. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

Sanctions and Risk Management

We use third party blockchain intelligence service providers (e.g., Chainalysis), in an attempt to detect, prevent, and mitigate financial crime and other illicit or harmful activities on the Interface. Such third-party providers may combine on-chain data and real-world investigations to identify financial crime and other high-risk activities. We apply an industry-wide standard of risk categories (e.g., sanctions, ransomware, child exploitation, stolen funds, etc.). Digital wallet addresses, or other identifiers, that fall into a risk category will be blocked from accessing the Interface. Digital wallet addresses connecting to the Interface will be cross-checked using a third party on-chain oracle service provider with designated risk categories. This risk-assessment process does not aim to identify users, but we cannot guarantee that identification of users will not occur. We do not retain the information we collect any longer than necessary for these purposes.

Governmental Entities

We may combine any information collected with information made available in third party databases and public sources. We may use such information to address claims, to respond to governmental inquires or requests, or to investigate issues. Further, such information may be shared with governmental entities including criminal, civil, and, regulatory agencies. Please be aware that we may keep copies of your information subject to our internal retention policies for the purposes of abiding by Applicable Laws or to prevent fraud or injury to a third party.

Opt Out of Commercial, Non-Commercial Communications and Do Not Track

If you decide to provide us with your contact information, you agree that we may send you communications via emails or other methods. However, you may choose to unsubscribe from certain communications by notifying us that you no longer wish to receive these communications, and we will endeavor to honor such requests promptly. Do Not Track ("DNT") is a concept promoted by certain regulatory authorities and industry groups for development and implementation of a mechanism that would allow internet users to control the tracking of their online activities across websites. Currently, various browsers (including Internet Explorer, Firefox, and Safari) offer a DNT option that allows a user to set a preference in the browser to not have his/her activities on the internet tracked. You can usually access your browser's DNT option in your browser's preferences. When a user's browser is set to DNT, some cookies and other tracking technologies may become inactive, depending on how the website visited responds to DNT browser settings. If that occurs, the website visited will not recognize you upon return to that website, save your passwords or user names, and some other features of a website may become unavailable or not function properly.

Given the lack of a standard in the industry or any clear regulatory guidance on this issue, we do not comply with DNT signals from your browser at this time.

Third Party Websites and Links

When accessing a third-party site through the Interface, you acknowledge that you are aware that these third-party websites are not screened for privacy or security issues by us, and you release us from any liability for the conduct of these third-parties. Please be aware that this Privacy Policy, and any other policies in place, in addition to any amendments, do not create rights enforceable by third parties. We bear no responsibility for the information collected or used by any third-party website. You must review their policies to understand how their information collection practices work.

Security Measures

As the Interface relies on Blockchain Technology and electronic infrastructure that we have no control over, we can make no guarantees as to the security or privacy of your information. Unfortunately, the transmission of information via the internet is not completely secure. Although we try to protect your personal information, we cannot guarantee the security of your personal information transmitted through or collected through the use of our Interface. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Interface. For this reason, we recommend that you use anti-virus software, firewalls, and other precautions to protect yourself from security and privacy threats.

Age Compliance

We do not intend to collect information for any persons under the age of majority in any applicable jurisdiction ("Minors"). Please do not submit information to us, or use the Interface, if you are a Minor. If you believe that we have collected any information from a Minor please contact us immediately, and we will endeavor to delete that information, if doing so is technically feasible.

International Transfers

Your information may be transferred to – and maintained on – computers located outside of your state, province, country, or other governmental jurisdiction, including in locations where the privacy laws may not be as protective as those in your jurisdiction. You specifically consent to our transfer of your information to other jurisdictions.
